Rights and Responsibilities of People with Disabilities

People with disabilities at the University of North Carolina at Pembroke have the RIGHT to:

    • Equal access to courses, programs, services, jobs, activities, and facilities offered through the university;
    • An equal opportunity to work and to learn and to receive reasonable accommodations, academic adjustments, and/or auxiliary aids and services;
    • Appropriate confidentiality of all information regarding their disability and to choose to whom, outside of UNC-P, information about their disability will be disclosed, except as disclosures are required or permitted by law;
    • Information which is reasonably available in accessible formats.

People with disabilities at the University of North Carolina at Pembroke have the RESPONSIBILITY to:

    • Meet qualifications and maintain essential institutional standards for courses, programs, services, jobs, activities, and facilities;
    • Identify themselves as individuals with disabilities when accommodations are needed and seek information, counsel, and assistance, as necessary;
    • Demonstrate and/or document from an appropriate professional how the disability limits their participation in courses, programs, services, jobs, activities, and facilities; and,
    • Follow published procedures for obtaining reasonable accommodations, academic adjustments, and/or auxiliary aids and services.

Rights and Responsibilities of the University of North Carolina at Pembroke UNC-P has the RIGHT to:

    • Identify and establish essential functions, abilities, skills, knowledge and standards for courses, programs, services, jobs, activities, and facilities and to evaluate students on this basis;
    • Request and receive, through Disability Support Services, current documentation that supports requests for accommodations, academic adjustments and/or auxiliary aids and services;
    • Deny a request for accommodations, academic adjustments and/or auxiliary aids and/or services if the documentation demonstrates that the request is not warranted or if the individual fails to provide appropriate documentation;
    • Select among equally effective accommodations, adjustments and/or auxiliary aids and services;
    • Refuse an unreasonable accommodation, adjustment, and/or auxiliary aid and/or service that imposes a fundamental alteration on a program or activity of the university.

UNC-P has the RESPONSIBILITY to:

    • Provide information to faculty, staff, students, and guests with disabilities, in accessible formats upon request;
    • Ensure that courses, programs, services, jobs, activities, and facilities when viewed in their entirety, are available and usable in the most integrated and appropriate setting;
    • Evaluate students and applicants on their abilities and not their disabilities;
    • Provide or arrange reasonable accommodations, academic adjustments, and/or auxiliary aids and services for students with disabilities in courses, programs, services, jobs, activities, and facilities;
    • Maintain appropriate confidentiality of records and communication, except where permitted or required by law.

2.1 It is the policy of UNC Pembroke to provide a notice for ADAAA access as required by federal law on all syllabi.  The following ADAAA Access Statement must appear on all course syllabi:

2.1.a.In post-secondary school settings, academic accommodations are not automatic; to receive accommodations, students must make a formal request and must supply documentation from a qualified professional to support that request. Students who believe they qualify must contact Disability Support Services (DSS) in DF Lowry Building, Room 107 or call 910-521-6695 to begin the accommodation process. All discussions remain confidential.  Accommodations cannot be provided retroactively.
